These are the rules for using Pairmest. They are an agreement between you and us, so we have written them in ordinary sentences rather than the usual wall of capital letters. They are no less binding for being readable.
1. Accepting these terms
By creating a Pairmest account or using the app, you agree to these terms. If you do not agree with them, please do not use Pairmest.
Our Privacy Policy explains what we do with your information. It is part of this agreement, so please read it too.
2. Who can use Pairmest
You must be at least 13 years old to use Pairmest. That is why we ask for your date of birth when you sign up.
If you are under the age at which you can agree to a contract on your own where you live, you may only use Pairmest with the involvement of a parent or guardian who agrees to these terms on your behalf.
You also need to be someone we are legally allowed to offer the service to, and not someone we have previously removed from Pairmest.
3. Your account and keeping it secure
You need an account to use Pairmest. When you create one, give us an email address that is really yours and information that is accurate — particularly your date of birth, since it is how we check the age requirement above.
Your account is yours alone. Keep your password private, and do not let anyone else sign in as you. You are responsible for what happens on your account.
If you think someone else has got into your account, tell us athello@pairmest.com as soon as you can, and we will help you secure it.
4. How you may use Pairmest
Pairmest is a private space for two people who want one. Use it that way. In particular, do not:
- Harass, threaten, abuse or intimidate anyone, including the person you are paired with. Pairmest is not a tool for controlling or monitoring another person.
- Upload content you do not have the rights to — photos someone else took, or anything that infringes another person’s copyright, trademark, privacy or other rights.
- Upload content of or about another person without their consent, including intimate images.
- Upload anything unlawful, or any material that sexually exploits or endangers a child. We report child sexual abuse material to the relevant authorities.
- Break, probe or overload the service — no scraping, no reverse engineering, no attempting to reach accounts or data that are not yours, no malware.
- Pretend to be someone else, or pair with someone by deceiving them about who you are.
- Use Pairmest to send spam or advertising, or resell access to it.
If you come across something on Pairmest that breaks these rules, emailhello@pairmest.com and tell us.
5. What you create, and the permission you give us
The moments, captions, calendar dates and prompt answers you add to Pairmest areyours. We do not claim ownership of them, and being on Pairmestdoes not change who owns them.
To be able to run the app at all, we need your permission to handle that content. So you give us a non-exclusive, worldwide, royalty-free licence to store, copy, back up and display your content — and to show it to the partner you are paired with — for the sole purpose of providing Pairmest to you. That is the whole licence.
We do not use your content to advertise, we do not show it to anyone other than you and your partner, we do not sell it, and we do not use it to train machine learning models. The licence ends when you delete the content or your account, except for copies that are still working their way out of our backups.
You are responsible for what you upload — that you have the right to upload it, and that it does not break the rules in §4.
6. Pairing and unpairing
Pairmest works in pairs. You can be paired with one person at a time, and pairing needs both of you to agree to it.
Once you are paired, your partner can see what you add to the shared space.Our Privacy Policy sets out exactly what they see, and it is worth reading before you pair with someone. We cannot make shared content unseen after they have seen it.
Either of you can end the pairing at any time, without needing the other’s agreement. What happens to content already in the shared space when a pairing ends is described in the Privacy Policy.
7. Availability and changes to the service
We want Pairmest to be there when you open it, but we cannot promise it will never be down. We may take it offline for maintenance, and things sometimes break.
We may add features, change them or remove them. If we are going to remove something you rely on, or stop the service altogether, we will give you reasonable notice and a way to get your content out first.
8. Ending your account
You can leave whenever you like. Delete your account in the app or by emailing us — here is how. You do not have to give a reason.
We may suspend or close an account if it breaks these terms, if we are required to by law, or if keeping it open would put other people at risk. Unless we are legally prevented, or doing so would make things worse for someone at risk, we will tell you why and give you a chance to respond.
When an account ends, the licence in §5 ends with it, and §§9, 10 and 11 continue to apply.
9. What we promise, and what we do not
We will provide Pairmest with reasonable care and skill. Beyond that, and to the extent the law where you live allows it, Pairmest is provided“as is”: we do not guarantee that it will be uninterrupted, error-free or secure against every possible attack, and we make no implied warranties of merchantability, fitness for a particular purpose or non-infringement.
We are not responsible for the content you or your partner put into Pairmest, and we are not responsible for what your partner does with something you shared with them.
Some places do not allow these exclusions. If yours is one of them, this section applies only as far as your law permits, and your statutory rights as a consumer are unaffected by anything in these terms.
10. Limits on our liability
To the maximum extent the law allows, we are not liable for indirect or consequential losses, for lost profits or lost data, or for anything that could not reasonably have been foreseen when you agreed to these terms.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.
11. Governing law
These terms, and any dispute arising from them or from your use of Pairmest, are governed by the law of the place where Pairmest is established, and the courts there have jurisdiction.
If you are a consumer, this does not take away the protection of the mandatory consumer laws of the country you live in, and you can always bring a claim in your local courts where your law gives you that right.
12. Changes to these terms
We may update these terms — usually because the app has changed, or the law has. When we do, we will change the “Last updated” date at the top of this page.
If a change materially affects your rights, we will tell you in the app or by email before it takes effect, so you have time to read it and to close your account if you would rather not accept it. Continuing to use Pairmest after a change takes effect means you accept the updated terms.
